RESOLUTION NO. 10169

IN THE MATTER OF MAKING PERMANENT THE SUSPENSION OF ALL ACTIVITIES IN CONNECTION WITH THE OCTOBER 31, 2016 SYNCHRONIZED BARANGAY AND SANGGUNIANG KABATAAN ELECTIONS

WHEREAS, the Commission on Elections (Commission) conducted activities and promulgated several resolutions in preparation for the for the October 31, 2016 Synchronized Barangay and Sangguniang Kabataan (SK) Elections; 

WHEREAS, on September 20, 2016, the Commission promulgated Resolution No. 10164, suspending all activities, including biddings and procurement, in connection with the 2016 Barangay and SK Elections, considering that: (1) bills postponing the October 31, 2016 Barangay and SK Elections have been filed in both Houses of Congress; (2) recent pronouncement of President Rodrigo Roa Duterte supporting the postponement; and (3) recent developments leaning toward postponement;

WHEREAS, on October 15, 2016, President Rodrigo Roa Duterte approved Republic Act No. 10923 entitled, "An Act postponing the October 2016 Barangay and Sangguniang Kabataan Elections, Amending for the Purpose Republic Act No. 9164, as Amended by Republic Act No. 9340 and Republic Act. No. 10656, Prescribing Additional Rules Governing the Conduct of Barangay and Sangguniang Kabataan Elections and for Other Purposes";

WHEREAS, Section 11 of R.A No. 10923 provides that it "shall take effect immediately after its publication in the Official Gazette or in two (2) newspapers of general circulation.";

WHEREAS, R.A. No. 10923 was published in two (2) newspapers of general circulation on October 22, 2016, and therefore, took effect immediately thereafter;

NOW, THEREFORE, pursuant to R.A. No. 10923, the Commission has RESOLVED, as it hereby RESOLVES, without prejudice to the rules and regulations that may be issued by it further implementing R.A. No. 10923, to:
  1. MAKE PERMANENT THE SUSPENSION of all activities for the conduct of the October 31, 2016 Barangay and Sangguniang Kabataan Elections in view of the effectivity of R.A. 10923 which, among others, postponed the said elections to October 23, 2017; and
  2. Direct all officials of the Commission and its deputies to preserve and maintain all documents, forms and supplies pertaining to the October 31, 2016 Barangay and Sangguniang Kabataan Elections that are in their custody, until further orders from the Commission.
Let the Office of the Deputy Executive Director for Operations and the Education and Information Department implement this Resolution.

The Education and Information Department, this Commission, shall cause the publication of this Resolution in two (2) newspapers of general circulation in the Philippines.
