OMNIBUS RULES ON CAMPAIGN FINANCE


In the matter of the STATEMENT OF CONTRIBUTION & EXPENDITURE (SOCE) of all candidates applicable starting May 09, 2016 elections and for all subsequent national and local elections, Commission on Elections promulgated Resolution No. 9991 last October 02, 2015 as the Omnibus Rules & Regulations Governing Campaign Finance and Disclosure or for brevity sake the "OMNIBUS RULES ON CAMPAIGN FINANCE".
STATEMENT OF CONTRIBUTION & EXPENDITURE or SOCE is the complete set of campaign finance disclosure or itemized election contribution received and expenditure incurred by a candidate and political party who participated in the elections.

For May 09, 2016 National & Local Elections (NLE) SOCE of all candidates 'WINNER or LOSER" are required to file personally or by authorized representative in the (3) legible copies to COMELEC offices where they filed their Certificate of Candidacy (CoCs). All documents/disclosure and attachments shall be submitted completely as required otherwise said submission shall be considered not files.

The candidate or political party treasurer must see to it that they had personally signed the STATEMENT OF CONTRIBUTION & EXPENDITURE or SOCE and executed under oath. All schedules, supporting document filed must conform to the Comelec prescribed forms. Supporting documents, such as contribution receipts, expenditures receipts, obligation payables, and advertising contracts must be submitted in both hard and soft/electronic copy forms in .PDF formats. All submission must be machine readable because handwritten is not allowed.

COMELEC prescribed form to be used by candidates, political party, mass media entities, election contractors and business firms, contributors and/or donors can be downloaded at comelec website. 
The aggregate amount that a candidate or political party may spend for election campaigns are as follows:
  • President and Vice President - Ten Pesos (P10.00) for every registered voters.
  • Other Candidates - Three Pesos (P3.00) for every registered voters in the constituency where the candidates filed their Certificate of Candidacy.
  • Independent Candidates - Five Pesos (P5.00) for every registered voters in the constituency where the candidates filed their Certificate of Candidacy.
  • Political Party and Party-List groups - Five Pesos for every registered voters in the constituency or constituencies where it has official candidates.
COMELEC Resolution No. 9991 further provides rules on election public rallies, political advertisement, authority to incur election expenditures, lawful election expenditures, lawful and prohibition on receipts of election contributions, raising of election funds and coverage of expenses, among others.
The Campaign Finance Unit (CFO) of the Commission on Elections shall serve as the primary office responsible for implementing all existing campaign finance laws, rules and regulations. Monitor fund raising and spending activity of candidate and political party through Comelec Field offices.

After COMPLETE compliance with the formal requirements of Statement of Contribution & Expenditures (SOCE) a Certificate of Formal Compliance shall be issued wherein said Certificate shall be presented by the winning candidate to the Department of Interior & Local Government (DILG) Officer to allow them to take their oath of office and to assume their functions and duties.

I pledge to vote for candidates who will abide by the duly constituted rules on campaigning because I understand that those who refuse to obey the law in the little things are not likely to obey the law in the more important things;

I pledge to vote for candidates who, by word and action, renounce violence, coercion, vote-buying, and corruption as means for getting elected;

I pledge to vote for the candidates who listen to their constituents and are responsive to the needs and aspirations of those they seek to represent;

I pledge to vote as my conscience dictates in all elections.

I make these promises freely and upon my honor.
