RESUMPTION OF THE SYSTEM OF CONTINUING REGISTRATION OF VOTERS IN CONNECTION WITH THE MAY 14, 2018 SYNCHRONIZED BARANGAY AND SANGGUNIANG KABATAAN ELECTIONS (BSKE).
WHEREAS, Republic Act No. 10952 otherwise known as “An Act Postponing the October 2017 Barangay and Sangguniang Kabataan Elections, Amending for the Purpose Republic Act No. 9164, as Amended by Republic Act No. 9340, Republic Act No. 10632, Republic Act No. 10656 and Republic Act No. 10923 And For Other Purposes”, was passed into law which effectively postpones the Synchronized Barangay and Sangguniang Kabataan Elections (BSKE) from October 23, 2017 to the second Monday of May 2018, that is on May 14, 2018;
WHEREAS, in view of the postponement of the BSKE, there is a need to resume the conduct of registration of voters for the members of the Katipunan ng Kabataan (KK) who will reach fifteen (15) years old pursuant to Republic Act No. 10742 and regular voters for the Barangay in connection with the May 14, 2018 Synchronized BSKE;
NOW, THEREFORE, pursuant to the powers vested in it by the Constitution, the Omnibus Election Code, Republic Act No. 8189, 10366, 10367, 10742 and other related election laws, the Commission on Elections (Commission for brevity) RESOLVED, as it hereby RESOLVES, to promulgate the following rules and regulations to govern the conduct of registration of voters for the May 14, 2018 Synchronized BSKE.
CHAPTER I
FILING OF APPLICATIONS
Sec. 1. Date, Time and Place for Filing of Applications.- Applications for registration, reactivation, change/correction of entries/and inclusion/reinstatement of records in the list of voters shall be personally filed at the Offices of the Election Officer (OEOs) of the city/district/municipality where the applicant resides, during office hours, from 8:00 AM to 5:00 PM, Mondays to Saturdays including holidays from November 6, 2017 (Monday) to November 30, 2017 (Thursday).
During the period of registration, the OEOs may conduct satellite/offsite registration of voters.
The resumption of the system of continuing registration of voters shall be conducted nationwide, except in the Province of Lanao del Sur.
No application for transfer of registration records shall be filed and be processed.
Sec. 2. Posting, Hearing and Approval/Disapproval of Application.- The applications for registration shall be heard by the Election Registration Board (ERB) at the OEO, in accordance with the following schedule:
Period to file applications - November 6, 2017 to November 30, 2017
Last Day to post Notice of Hearing
With Lists of Applicants - December 4, 2017
Last Day to file opposition to
Application - December 11, 2017
Hearing and Approval/Disapproval
Of Applications - December 18, 2017
If the last day to post notice, file opposition and hearing for approval disapproval falls on a holiday or a non-working day, the same shall be done on the next working day. Further, the ERB hearing shall be conducted for a period not to exceed five (5) days.
Sec. 3. Who May Register.- Any Filipino citizens who is not yet registered either as SK or as regular voter, may apply for registration, provided he/she possesses the following qualifications:
A. SK Voters:
1) At least fifteen (15) years of age on or before May 14, 2018 BSKE but not more than thirty (30) years old;
2) Residing in the barangay for at least six (6) months on or before May 14, 2018 BSKE; and
3) Not otherwise disqualified by law.
B. Regular Voters
1) At least eighteen (18) years of age on or before May 14, 2018 BSKE;
2) A resident of the Philippines for at least one (1) year and in the place wherein he/she proposes to vote, for at least six (6) months immediately preceding the elections; and
3) Not otherwise disqualified by law.
Section 4. Voters who are not required to file application for registration.- The following shall not register anew:
1) SK voters registered from July 15, 2016 to July 30, 2016 and from November 7, 2016 to April 29, 2017, whose registration records will remain in the SK database, except those who will be thirty-one (31) years of age on May 14, 2018 Synchronized BSKE.
2) SK Voters, above stated, who will reach eighteen (18) years of age on or before May 14, 2018 Synchronized BSKE, their extracted names shall be included in the list to be submitted to the ERB for consideration. If approved, they shall also be included in the list of regular voters for the Barangay elections.
3) Barangay registered voters with age range from eighteen (18) years of age to thirty (30) years of age, their registration records will also be included in the list of voters for the SK elections.
Sec. 5. Who are Disqualified to Register.- The grounds for disqualification on registration shall be governed by Section 10 of Resolution No. 9853.
Sec. 6. Application Forms.- The following are the application forms:
a) Annex “A” (CEF-1A – Application for Registration);
b) Annex “B” (CEF-1C – Application for Reactivation);
c) Annex “C” (CEF-D – Application for Change/Correction of Entries/ and Inclusion/Reinstaement of Record in the List of Voters);
d) Annex “D” – Supplementary Data Form; and
e) Annex “E” – Certification of Registration of Applicant whose name is not found in the National List of Registered/Deactivated Voters (NLRDV).
These forms may be secured as follows:
1. From the OEO, FREE OF CHARGE.
2. From the Comelec website (www.comelec.gov.ph). The applicant may choose from any of the two (2) options:
a. Download the blank form (long bond paper substance 20/70 gsm) and manually fill-out the same; or
b. Electronically fill-out the appropriate form, and print/reproduce three (3) copies thereof, for submission to the concerned EO (Online Application Form).
The application forms for KK registration shall be stamped with the word “KATIPUNAN NG KABATAAN” at the upper portion of the text box “Application for Registration” and in the Acknowledgement Receipt.
Sec. 7. Procedure for Filing of Applications.- The procedures on personal filing of applications and mandatory biometrics data capturing in the Voter’s Registration Machines under Resolution No. 9853 and Resolution No.10166 shall be strictly observed.
Sec. 8. Last Day Registration Scenario. During the last day of registration the following procedures shall be observed:
a. If at 3:00 o’clock p.m. of November 30, 2017, there are still persons waiting in line to file their applications within thirty (30) meter radius in front of the OEO or any other place/s where the reception of applications is conducted, the Election Assistant (EA) shall, without delay list down their names consecutively numbered;
b. The listed applicants shall be called by announcing each name repeatedly three (3) times in the order in which they were listed. Any applicant who is not present during called shall no longer be allowed to file application;
c. If the applicant is present when called, the application shall be processed and the biometrics data captured. The same shall continue, until all those listed shall have been processed. This procedure shall be followed whether the EO has issued queuing numbers or any other similar systems; and
d. Any application filed where the applicant’s biometrics data has not been captured as provided herein, shall be considered deemed not filed and should not be submitted to the ERB for hearing.
CHAPTER II
ELECTION REGISTRATION BOARD
Sec. 9. Election Registration Board (ERB).- In the conduct of ERB hearings, the provisions of Resolutions No. 9853 and No. 10148 not inconsistent herewith, shall be applicable.
Sec. 10. Generation of List/Extraction/Consolidation/Deletion of Registration Records.- The EO shall:
A. Before ERB hearing, generate, print and submit to the ERB the following lists:
1) First time registrants for SK aged 15 to 17 and for barangay aged 18 and above; and
2) SK voters as of May 15, 2017 ERB hearing who will reach eighteen (18) years of age for purposes of the May 14, 2018 Synchronized BSKE.
The said lists shall be subject to the usual procedures of posting, hearing and approval/disapproval by the ERB in accordance with schedule provided in Section 2 of this Resolution.
3) Names of regular voters for manual cross-out by reason of double/multiple registration records, inclusion in the certified list of deceased persons of voting age and exclusion by court order.
B. After ERB hearing:
1) Extract registration records of SK voters from the SK database who are eighteen (18) years of age and store in the regular voters database;
2) Delete in SK database the registration records of voters who will be thirty-one (31) years of age on the day of the May 14, 2018 Synchronized BSKE; and
3) Extract voters aged fifteen (15) to thirty (30) using the EXTRACT command.
The ITD will provide all the necessary technical procedures/programs/patches in the generation, extraction, consolidation and deletion of registration records.
Sec. 11. Election Day Computerized Voters Lists (EDCVL) and Posted Computerized Voters Lists (PCVL).- The EO shall:
1. Generate anew the EDCVL and PCVL for the May 14, 2018 Synchronized BSKE. Newly printed EDCVL and PCVL shall be subject to verification, certification and sealing pursuant to Resolution No. 10188 dated July 19, 2017; and
2. Take custody, maintain and preserve the previously printed EDCVL and PCVL as of May 15, 2017 ERB, until further orders by the Commission pursuant to Resolution No. 10212 dated October 4, 2017. Unauthorized release and use of previously printed EDCVL and PCVL shall be subject to administrative and/or criminal liability.
Sec. 12. Segregation, Custody and Back-Up of Database in Compact Disc.- The provision of Resolution No. 9853 on segregation, custody and back-up of database in compact discs shall be applicable.
Failure to create back-up copy of the database shall be subject to disciplinary action.
A. Election and Barangay Affairs Department (EBAD)
a. Quarterly Progress Reports (soft copy)
b. Updated Quarterly Reports on PWDs and SCs (soft copy)
c. Updated Quarterly Reports on ICCs/IPs and IDPs (soft copy)
d. Other reports.
B. Information Technology Department (ITD)
a. SNPDAT; and
b. SK Database
Quarterly Progress Reports, Project of Precincts (POPs), SNPDAT, SK Database and other required reports shall be submitted to EBAD and ITD respectively, not later than January 5, 2018 (Friday);
Sec. 14. Compilation of Voter’s Registration Records (VRRs).- The compilation of the original copies of the newly approved applications shall be in accordance with Section 22 of Resolution No.10166.
Sec. 15. Petition for Inclusion or Voters in the List.- Any person whose application for registration has been disapproved by the ERB or whose name has been stricken out from the list, may file with the court, a petition to include his/her name in the permanent list of voters in his/her precinct at any time but not later than January 29, 2018 (Monday). It shall be supported by a certification of disapproval of his/her application and proof of service of notice of his/her petition upon the ERB. The petition shall be decided within fifteen (15) days after its filing.
If the decision is for the inclusion of the voter’s name in the permanent list of voters, the ERB shall place the application for registration previously disapproved in the corresponding book of voters and indicate in the application for registration the date of the order of inclusion and the court which issued the same.
Sec. 16. Petition of Exclusion of Voters from the List.- Any registered voter, representative of a political party or the EO, may file with the court a sworn petition for the exclusion of a voter from the permanent list of voters giving the name, address and the precinct of the challenged voter at any time but not later than February 3, 2018 (Saturday). The petition shall be accompanied by proof of notice to the ERB and to the challenged voter and shall be decided within ten (10) days from its filing.
If the decision is for exclusion of the voter’s name from the list, the ERB shall upon receipt of the final decision, remove the voter’s registration records from the corresponding book of voters, enter the order of exclusion and place the same in the inactive file.
Sec. 17. Implementation of Court Inclusion/Exclusion Order.- The ERB shall implement Court Inclusion/Exclusion Orders that will become final and executory not later than February 10, 2018 (Saturday). Otherwise, the same shall be referred to the Law Department.
The EO shall request from the ITD through EBAD the issuance of the access code to effect the inclusion/exclusion of the registration records of the concerned voter’s in the database.
Sec. 18. Abatement of Double/Multiple Registration Records.- Automated Fingerprints Identification System (AFIS) Results forwarded to OEOs shall be submitted to ERB hearing on December 18, 2017 (Monday) for abatement process.
Thereafter, actual deletion in the Voter’s Registration System (VRS) pursuant to the policy adopted in Resolution No. 9888, shall be made prior to the submission of the SNPDAT and SK Database to ITD.
Non-compliance with the abatement of double/multiple registration shall be subject to administrative disciplinary action.
Sec. 19. Deactivation and Cancellation of Registration Records.- The grounds for the deactivation of registration records provided in Resolution No. 9863, except Failure to Vote Twice, and cancellation of registration records in Section 36 of Resolution No. 9853, shall be applicable.
Sec. 20. ERB Certification of the List of Voters.- The ERB shall post notice of its meeting for the Certification of the Lists of Voters. Said meeting shall be conducted at least five (5) days, prior to the scheduled posting of the certified and final list of voters’ in the bulletin boards of OEO and the city/municipal hall.
The procedure in Resolution No. 10188 dated July 19, 2017 insofar as the conduct of verification, certification and sealing of the Election Day Computerized Voters Lists and Posted Computerized Voters Lists shall be strictly observed.
Sec. 21. Posting of the Certified and Final List of Voters.- The ERB shall post the certified and final list of voters (SK and Barangay) in the bulletin board of the OEO not later than February 13, 2018 (Tuesday).
Sec. 22. Role of the Regional Election Directors (REDs) and Assistant Regional Election Directors (AREDs) and Provincial Election Supervisors (PESs).- The REDs, AREDs and PESs shall monitor the conduct of registration, ensure timely compliance of the EOs submission of all the required reports and shall be directly responsible and accountable for non-compliance within the period herein provided.
Sec. 23. Applicability of Other Resolutions of the Commission.- Pertinent provisions of Resolutions Nos.: 9853, 9863 and 10166, and other Resolutions of the Commission, pertaining to registration insofar as applicable and not inconsistent herewith, shall apply.
For this purpose, the implementation of Section 4 Item B of Resolution No. 10166 on the conduct of registration of voters starting December 4, 2018 for the May 13, 2019 National and Local Elections is hereby set aside further notice.
Sec. 24. Information Dissemination.- The Education and Information Department (EID) shall be directed to cause the widest dissemination of this Resolution and its publication.
EOs shall likewise cause the widest information dissemination of this Resolution and coordinate with the concerned citizens’ arms, local government units, barangay officials, non-governmental/civic organizations and other vulnerable sectors/organizations in their respective areas of responsibility.
Sec. 25. Effectivity.- This Resolution shall take effect seven (7) days after its publication in two (2) daily newspapers of general circulation in the Philippines.
Let the Office of the Deputy Executive Director for Operations, Election and Barangay Affairs Department, Information Technology Department, Finance Services Department, Regional Election Directors, Provincial Election Supervisors and Election Officers implement this Resolution.
