BARANGAY & SK ELECTIONS UPDATE

The nature of the Barangay and SK Elections is non-partisan and shall be conducted in an expeditious and inexpensive manner.

Officials to be elected are One (1) Punong Barangay and Seven (7) Members of the Sangguniang Barangay and for Sangguniang Kabataan (SK) are One (1) Chairman and Seven (7) Members of Sangguniang Kabataan.
Qualified candidates for barangay elections are those Filipino citizens who must be a registered voter and resident of the barangay where he intends to be a candidate for at least one (1) year preceeding October 28, 2013 Elections and not less than eighteen (18) years of age. While for Sangguniang Kabataan they must be fifteen (15) years old but less than eighteen (18) years old and not convicted in any crime involving moral turpitude. The SK candidates must be a registered voter of the Katipunan ng Kabataan.

Ten (10) days Campaign period is set on October 18-26, 2013 which will be governed by the rules and regulations issued by the Comelec implementing Republic Act No. 9006 otherwise known as the “Fair Election Act” and by Resolution on Campaign Finance and Disclosure. Usually, Common Poster Areas are designated in Barangay Halls, Barangay Plazas and Public Markets.

The aggregate amount that a candidate may spend for Barangay and Sangguniang Kabataan elections is fixed to Five (5) pesos for every voters currently registered in the barangay where he/she filed their Certificate of Candidacy.

September 28, 2013 is the beginning of election period for Barangay and Sangguniang Kabataan Elections and ends on November 12, 2013. Thirty (30) days before October 28, 2013 Election Day and fifteen (15) days thereafter.

Some of the prohibited activities during this period includes ban on carrying of firearms or other deadly weapons, availment/employment or engagement of the services of security personnel and bodyguards, appointment and hiring of new employees, creating or filling of new positions, giving salary increases or transferring or detailing any officers or employees of civil service and suspension of elective officials, among others. Establishment of COMELEC Checkpoints will be effective/enforced by deputized law enforcement agencies.

Gun Ban issued in connection with the May 13, 2013 National and Local Elections shall be recognized as valid for purposes of October 28, 2013 Barangay and Sangguniang Kabataan Elections. However application for employment and availment/engagement of security personnel services during the May 13, 2013 shall be subject for renewal.

Prohibition against construction or maintenance of provincial, city, municipal, or barangay roads and bridges shall take effect on October 18-28, 2013 per Comelec Resolution No. 9749.

Pursuant to Comelec Resolution No. 9740 filing of Certificate of Candidacy (COC) is set on October 15-17, 2013 at the Offices of the Election Officers in city/municipality having jurisdiction over each and every barangays from 8:00a.m-5:00pm. However, recently media news reports that COMELEC Spokesperson James Jimenez disclosed the extension of filing of Certificate of Candidacy for six (6) days instead of three (3) days. This was confirmed by Comelec Resolution No. 9761 issued August 23, 2013 prescribing October 11, 12, 14, 15, 16 and 17 as the new period of filing Certificate of Candidacy.

Certificate of Candidacy (COC) in Comelec prescribed form in triplicate legible copies shall be filed and accepted starting on October 11, 2013. COCs shall be pasted with fifteen pesos (PhP15.00) documentary stamp, passport size photo and sworn in to a Notary Public or any officer duly authorized to administer oath.

COCs shall be filed personally by the candidate or his authorized representative, whose authority shall be in writing, under oath and thereto attach. COCs filed or sent thru mail, electronic mail, telegram or facsimile will not be accepted.

Upon filing of COC any government appointive officials or employees shall be considered ipso facto resigned from their offices unlike elective officials who shall not be considered resigned.

Republic Act No. 9164 provides that “No barangay elective official shall serve for more than three (3) consecutive terms in the same position”, therefore third termer barangay officials are barred from running for the same barangay elective positions.

Every candidate winner or loser after October 28, 2013 Elections are obliged and required to file with the offices of the Election Officer where they filed their Certificate of Candidacy, in triplicate copy, the itemized Statement of Contributions and Expenditures relative to their candidacy in the Barangay and Sangguniang Kabataan Elections. The last day to file Statement of Contributions and Expenditures shall be on November 27, 2013. Fail not, under penalty of law.

VOTERS' PLEDGE

I am a Responsible and Principled Citizen.

I will educate myself and others about the issues at hand so that my vote is a meaningful and relevant exercise of my right of suffrage.

I pledge to vote for candidates who will abide by the duly constituted rules on campaigning because I understand that those who refuse to obey the law in the little things are not likely to obey the law in the more important things;

I pledge to vote for candidates who, by word and action, renounce violence, coercion, vote-buying, and corruption as means for getting elected;

I pledge to vote for the candidates who listen to their constituents and are responsive to the needs and aspirations of those they seek to represent;

I pledge to vote as my conscience dictates in all elections.

I make these promises freely and upon my honor.
